ISLAMABAD: The Supreme Court on Monday issued notices to the heirs of Asghar Khan after the Federal Investigation Agency (FIA) recommended closure of the inquiry for initiating action against politicians who allegedly received money from the country’s premier intelligence agency ahead of the 1990 general elections.
A two-member bench headed by Chief Justice Mian Saqib Nisar resumed the hearing regarding the non-implementation of its October 19, 2012 judgment in the Asghar Khan case after the FIA submitted a report recommending to ‘close the matter on merit’ as the agency could not obtain evidence to initiate criminal proceedings against the accused politicians.
During the hearing, Justice Ijazul Ahsan observed that the accused cannot be convicted on news clippings.

The report, it was learnt, stated that the agency could not find relevant records since the matter was 24-years old. It added that witness testimonies also contain many gaps and do not match.
The report added that the politicians accused of receiving money for rigging elections have also denied the charges and no proper record has been recovered of money being transferred from related accounts to those of anyone involved.
While the FIA was investigating politicians in the case, the GHQ had been referred to probe military officials involved in the distribution of funds.
